Chapter 5. The protection of copyright and contiguous rights

Article 42. The infringement of copyright and contiguous rights 

For the infringement of copyright and contiguous rights, responsibilities are stipulated according to the legislation of the Republic of Armenia.

Any action, contradicting this Law, is considered to be an infringement of copyright and contiguous rights. The copy created as a result of this infringement is considered to be illegal.

A copy of a work or a phonogram, protected by the law of the Republic of Armenia and imported, without the author's consent, from a country, where the work or the phonogram have never been or are no longer protected, is also considered illegal.

Article 43. The protection of copyright and contiguous rights

The copyright owner and the owner of contiguous rights, while protecting his rights, may demand:

a) an acknowledgement of his rights;
b) a reestablishment of the situation, existing before the violation of rights, and a termination of the activities, violating the right and containing a violation threat;
c) the illegal copy, its confiscation or destruction;
d) a reimbursement of losses, including the lost profit, in an order, established by the legislation of the Republic of Armenia.

In case the demands of copyright owners or owners of contiguous rights are not satisfied, the rights may be protected in a judicial order.

Article 44. The ways of ensuring the lawsuit on the infringement of copyright and contiguous rights

The court or the judge may, on the basis of the application submitted by the persons participating in the case or on his own initiative, take measures to ensure the lawsuit - to place a ban on all the supposed illegal copies of the works and phonograms, as well as on the materials and the equipment designed for their creation and reproduction, to ban certain activities.

If there are enough data on the infringement of copyright and contiguous rights stipulating criminal responsibility, legal bodies, authorized by legislation to ensure the lawsuit that was presented or was possible to happen in the future, are obliged to take measures - to arrest all the supposed illegal copies, as well as the materials and the equipment designed for their creation and reproduction, and, if necessary, to confiscate and store them.
